Post-employment covenants are usually enforced by employers through preliminary injunctions and temporary restraining orders. The overriding emphasis on these actions is speed, in order to stop a departing employee in his tracks.
Departing employees may seek to defeat post-employment covenants preemptively. This can be achieved by requesting that a court declare a covenant invalid or limit it based either on the law regulating covenants or on the simple theory that a breach by the employer excuses the employee from any obligation to comply.
